Terms of Service
I keep things fair. I do the work, I meet my deadlines, and I expect to be paid without having to chase anyone. That’s the whole deal.

1. Agreement
These terms apply to this website and to every service provided by syndek (“I”, “me”). By requesting, paying for or using my services, or by using this site, you agree to them. If you do not agree, please do not use my services. A written quote or proposal may add specifics for a project; where it conflicts with these terms, the quote wins for that project only.
2. How we work together
I take responsibility for my work. I meet the deadlines we agree on, I communicate clearly, and I deliver what was quoted. In return I need the same from you: timely feedback, the materials I ask for, and prompt payment. Long working relationships are built on trust, and I value them. If that trust is broken, whether by non-payment, dishonesty or abuse, the relationship ends and I will not take further work from you.
3. Quotes and scope
Every project starts with a written quote describing the work, the deliverables, the timeline and the price. Anything not listed in the quote is not included. Changes, additions and “while you’re at it” requests are welcome, but they are quoted and paid for separately before I start on them. Nothing on this site is a quote or an offer until I have confirmed it in writing.
4. Payment
- Credit card only. All payments are made by credit or debit card through my payment processor. I do not accept checks, cash, bank transfers, crypto, barter or exchanges of any kind.
- When it’s due. Unless the quote says otherwise, a deposit is due before work begins and the balance is due on delivery. Invoices are due on receipt.
- Don’t make me chase you. If a payment is late, work stops and deadlines move until the account is settled. Files, source material and final deliverables are released only when payment is complete. Balances more than 30 days overdue may be sent to collections, with any collection costs and legal fees added to what you owe.
- Chargebacks. Disputing a legitimate charge with your card issuer instead of talking to me is a breach of these terms. I will contest it with the full project record and pursue the amount owed.
- Taxes and paperwork. Prices exclude any applicable sales tax. Because every payment goes through a card payment processor, that processor reports the income to the IRS on my behalf. You therefore do not need to issue a 1099 for card payments, and I do not issue W-9 forms for them.
5. All sales are final
Creative work is custom made for you and cannot be resold or reused. For that reason all sales are final. There are no refunds, no partial refunds, no credits and no exchanges, including for deposits, work already started, or projects you decide not to use. If you are unsure about something, ask before you pay.
6. No spec work, no loans
I do not do speculative work, free samples, “test” projects or design contests. I do not lend money, extend credit, defer payment in exchange for equity, or take payment in future promises. Work begins when the deposit clears.
7. Abandoned projects
A project is abandoned when you go 30 consecutive days without responding to my messages, providing requested materials or approving a stage of the work. When that happens the project is closed, all payments made are forfeited as compensation for time reserved and work done, and no refund or credit is owed. Restarting an abandoned project is treated as a new project with a new quote, at my discretion.
8. Deadlines and your side of them
I meet the deadlines we agree on. Those deadlines assume you provide feedback, content and approvals within the time set out in the quote (usually within five business days). If you are late, the deadline moves by at least the same amount, and rush fees may apply to get back on schedule.
9. Revisions
Each quote includes a stated number of revision rounds. A revision refines the direction we agreed; it does not mean starting over or changing the brief. Extra rounds or a change of direction are quoted separately.
10. Your materials
You confirm that anything you give me to use, such as logos, text, photos, fonts and other assets, is yours to use or properly licensed, and that it does not infringe anyone’s rights. You are responsible for the accuracy of the content you supply and for any claims arising from it.
11. Ownership and rights
Until the project is paid in full, all work remains my property and may not be used. On full payment, the rights to the final deliverables described in the quote transfer to you. I keep the rights to my source files, unused concepts, sketches and rejected directions, and to any tools, templates or techniques I use across projects. Stock assets and fonts remain under their own licenses. I may show finished work in my portfolio with your permission, as described in the Privacy Policy.
12. Right to refuse service
I reserve the right to refuse or discontinue service to anyone, for any reason, at any time. If I end a project for reasons other than your breach of these terms, I will refund any deposit for work not yet started.
13. No guarantees of outcome
I deliver professional creative work to the agreed brief. I cannot and do not guarantee business results such as sales, traffic, rankings, awards or approval by third parties. My services and this site are provided “as is” without warranties of any kind beyond what the law requires.
14. Limitation of liability
To the fullest extent permitted by law, my total liability for any claim connected with a project or this site is limited to the amount you actually paid me for that project. I am not liable for indirect, incidental or consequential losses, including lost profits, lost data or business interruption. You agree to indemnify me against claims arising from materials you supplied or from your use of the work.
15. Confidentiality
Everything you share with me is confidential. The details are in the Privacy Policy, which forms part of these terms.
16. General
These terms are governed by the laws of the State of Texas in the United States of America, and any dispute will be handled in the courts here. If any part of these terms is found unenforceable, the rest still applies. My not enforcing a term on one occasion does not waive it. These terms may be updated from time to time; the version on this page at the time you engage my services is the one that applies to that project.
